Definition and scope of application

1.1 definitions

1.1.1"Scout" is browser software developed by a Scout team and provided for download, installation, and updates.

1.1.2"User" means a natural person or legally authorized representative who downloads, installs, accesses or otherwise uses Scout.

1.1.3"This agreement" means this Scout browser user agreement and any subsequent revisions thereto.

1.2 scope

1.2.1 this agreement applies to all use of the Scout browser by users worldwide.

1.2.2 if users access third-party websites or services through Scout, they are subject to the terms and policies of those third parties.

Permissions and restrictions

2.1 licensing

2.1. The Scout team grants the user a personal, non-transferable, non-exclusive, revocable and limited license to install and use Scout on equipment that complies with this agreement.

2.1.2 a user shall not reverse engineer, decompile, disassemble or otherwise attempt to obtain the source code for a Scout unless the open source component is otherwise provided under its license.

2.2 prohibited acts

2.2.1 no statement of copyright, trademark or other right in Scout shall be deleted or modified.

2.2.2 Scout shall not be used to create, upload, download or disseminate content that is contrary to the law or that infringes on the legitimate rights and interests of third parties.

2.2.3 do not interfere with or disrupt the normal operation of the Scout in any way, including but not limited to automated program scraping, malicious brushing traffic, and malicious code injection.

Account and synchronization services

3.1 obligations of registration

3.1.1 users shall provide true, accurate and complete registration information which shall be updated as and when it is changed.

3.1.2 users are responsible for all activities under their accounts and must not share passwords with others or authorize others to use their accounts.

3.2 data synchronization

3.2.1 Scout Sync uses end-to-end encryption, where the encryption key is held only by the user; if the user loses the key, the Scout team can not recover the encrypted data.

3.2.2. Users can choose the scope of synchronization and turn off or remove data from the cloud at any time in"Settings".

Content and intellectual property

4.1 user content

4.1.1 the content (e.g. extensions, themes, bookmarks) submitted, uploaded and published by users in the course of using Scout shall be guaranteed legal rights.

4.1.2 the user grants the Scout team a worldwide, royalty-free, non-exclusive license to use the above content solely for the purpose of providing, improving, and presenting the service.

4.2 Scout intellectual property

4.2.1 Scout and its built-in icons, interface design, source code, trademarks, etc. shall be the property of Scout team or its licensor and this agreement does not constitute any assignment of rights.

4.2.2 no user shall remove, obscure or alter any copyright, trademark or other right indication while using Scout.

Privacy

5.1 privacy policy invocation

5.1.1 Scout's rules for the handling of personal information shall be governed by the Scout browser privacy policy, which is an integral part of this agreement.

5.1.2 a user who reads and consents to this agreement is deemed to have read and consented to the privacy policy.

Auto-update with third-party components

6.1 automatic updates

6.1.1 for security and functional integrity, Scout turns on automatic updates by default; users can turn them off in settings-advanced, but if they do, security vulnerabilities may not be fixed in time.

6.1.2 no separate user confirmation is required for the update action, but significant functional changes will be indicated in the update notes.

6.2 third-party components and open source licenses

6.2.1 Scout may integrate with third-party decoders, extension frameworks, or open source libraries; its use is subject to the appropriate license, and the Scout team does not guarantee the availability of third-party components.

Disclaimer

7.1 provision of services"As is"

7.1. The 1scout team makes no express or implied warranties as to the timeliness, safety, or accuracy of the services provided.

7.1.2 users are at their own risk as a result of network conditions, the behaviour of third-party websites or the compatibility of equipment.

7.2 force majeure

7.2(1) disruption of services, loss of data or damage to equipment due to force majeure events such as earthquakes, fires, floods, wars, government actions, hacking attacks, network congestion, etc. , the Scout team is not responsible.

Limitation of liability

8.1 maximum compensation

8.1.1 in any event, the Scout team shall be responsible for any direct, indirect, incidental, special or subsequent loss to the user caused by the use or inability to use the Scout, the total liability shall not exceed the total amount paid by the user to the Scout in the 12 months prior to the occurrence of the claim; the Scout team shall not be liable if the user has not paid any fee.

Breach of contract and termination

9.1 default treatment

9.1.1 the Scout team reserves the right to suspend or terminate the service without notice in the event of a breach of this agreement by the user, and reserves the right to pursue legal action.

9.1.2 the user shall bear full responsibility and indemnify the Scout team for any damages incurred by any third party as a result of the user's breach of contract.

9.2 termination of agreement

9.2.1 at any time the user may uninstall Scout to terminate this agreement; after termination, the Scout team shall cease to collect new data from the user unless otherwise provided by law or by agreement between the parties.

9.2.2 termination of the agreement shall not affect the validity of the provisions of the agreement relating to intellectual property, limitation of liability, dispute settlement, etc. .

Applicable Law and dispute resolution

10.1 applicable law

10.1.1 the formation, implementation and interpretation of this agreement shall be governed by the law of the area where it is issued.

10.1.2 if Internet information services are otherwise mandatory under the law of the user's location, they shall be settled by negotiation, provided that they do not conflict with 10.1.1.

10.2 dispute settlement

10.2.1 the parties shall first settle the dispute through friendly consultations; if such consultations fail, either party may institute proceedings before the court.

11.1.2 an email sent by the user is deemed to have been validly delivered; the Scout team will provide a substantive response within 15 working days of receipt of the email.
